Buying a resale flat in Navi Mumbai: 10 checks before you pay

Title documents, CIDCO transfer, society NOC, dues and loans: ten checks to make before you pay for a resale flat.

A resale flat lets you see exactly what you are buying and move in quickly. But you also take on the flat's history. Make these ten checks before you pay more than a small token amount.

Documents

  1. Chain of ownership. Ask for all previous agreements, back to the original allotment or builder agreement, with their registration receipts and Index II.
  2. Title search. Have a lawyer check the title and search the registration records for any mortgages, disputes or claims.
  3. Occupancy certificate (OC). Check that the building has an OC. Buildings without one can face problems with loans, water and electricity connections, and resale.

Society and CIDCO

  1. CIDCO lease and transfer. Much of Navi Mumbai is on land leased by CIDCO. Depending on the property, a transfer may need CIDCO's permission and transfer charges. Check this early with the society and your lawyer.
  2. Society NOC and share certificate. The seller should hold the original share certificate. The society should give a no-objection certificate for the sale.

Dues and loans

  1. Property tax. Ask for the latest property tax receipts from the municipal corporation.
  2. Maintenance and utility bills. Ask for a no-dues letter from the society, and check the electricity and water bills are paid.
  3. Existing home loan. If the seller has a loan on the flat, the bank holds the original documents. Plan how the loan will be closed and the documents released as part of the payment.

The flat itself

  1. Inspection. Check for leaks, cracks and dampness, and measure the carpet area. Ask about the building's age, any structural audit, and whether redevelopment is being discussed.

Closing the deal

  1. Agreement and registration. Pay by traceable bank transfer, not cash. Sign a written agreement, pay the stamp duty and registration fee, and register the sale at the Sub-Registrar office. Check current rates on the IGR Maharashtra website.
